Notes: He was shot by Jim Cumming. There are two stories describing the incident. One says Villa was shot in the back as he road down the sandy riverbed below Tumacácori. The other story says that Villa road out of the brush and shot at the Cumming brothers and Jim Cumming fired two shots in return as Villa’s horse wheeled and reared upon hearing the first shot. While the jury believed the second story, the medical report showed the bullet entered Villa’s back at the left shoulder blade traveling downward until it hit the outer edge of the sternum where it was deflected up a half inch and exited his body in front below the third rib. Dr. W.F. Chenoweth testified that the person firing the shot “was up considerably higher than [the horse] Villa was riding” and that “he would have [had] to be up above Villa to have made that wound.” Regardless, the black, bald faced horse Villa was riding, galloped for home from the riverbed, across the Tumacácori National Monument, stopping short in front of the Villa residence, where Senovio fell to the ground, dead.
